Terms of service
1. GENERAL INFORMATION
These general terms and conditions of sale (“General Terms and Conditions”) define the terms and conditions of sale between NMGC S.R.L., with registered office in Busto Arsizio (Va), Via San Michele 15, VAT number 03724240126 (“NMGC S.R.L.” or “Seller”), and the purchaser (“Customer”) who intends to purchase the products offered by NMGC S.R.L. (“Products”), sold through the website www.nadetteboutique.com (“Site”).
For contracts entered into between the Seller and Italian Customers who act within the Italian territory for personal and non-professional purposes, the rules on distance contracts as per Articles 51 et seq. of Legislative Decree no. 206/2005 (Consumer Code), as amended by Legislative Decree no. 21/2014, implementing Directive 2011/83/EU, shall apply. In this case, the Customer is a consumer who has reached the age of majority and is resident in Italy.
NMGC S.R.L. may modify the General Terms and Conditions at any time. It is understood that the version of the General Terms and Conditions published at the time of the contract’s conclusion will be binding between the parties. In any case, NMGC S.R.L. will not be bound by any conditions unilaterally established by the Customer.
At the time of placing an order, which must be complete in all its parts and contain the essential elements for the precise identification of the Product ordered, the Customer must declare:
• if residing in the Italian territory, that they are a consumer as defined by Article 3, paragraph 1, letter A) of the Consumer Code;
• to be of legal age;
• that the data provided for the execution of the contract is accurate and truthful;
• to have read and fully accepted the General Terms and Conditions indicated on the Site.
The General Terms and Conditions form an integral part of any proposal, purchase order, and order confirmation for the Products.
For any needs, the Customer can contact the Seller at the following e-mail address: shop@nadetteboutique.com. NMGC S.R.L. will respond to the customer’s requests within 48 hours; requests sent on Saturdays and/or Sundays and/or Italian public holidays will be processed on the next working day.
2. PRODUCTS SOLD AND CHARACTERISTICS
Through the Site, NMGC S.R.L. offers for sale the Products, understood as women’s clothing and accessories available in stock.
Each Product is sold individually.
On the Site, the Customer will find an image of each Product, with a description of its main characteristics and the relative price.
3. CONCLUSION OF THE CONTRACT
To make a purchase, the Customer must select one or more Products and add them to the “shopping cart,” where the Customer will find a summary of the Product’s price, the applicable VAT, the selected Product’s characteristics, shipping costs if not included in the Product’s price, and the expected delivery times.
The purchase process continues with the Customer’s registration on the Site, which is entirely free. During registration, the Customer will be required to provide personal data, also necessary for invoicing, and guarantee its accuracy. The Customer agrees to promptly notify NMGC S.R.L. of any changes to their personal data provided during registration by sending appropriate communication to the Seller.
Following registration, the Customer must enter, in the relevant section, the shipping address for the purchased Product and the necessary data to make the payment.
The shipping address may differ from the Customer’s residential address. In fact, the Customer has the option, if they wish to make a gift, to have the purchased Product delivered directly by the Seller to the gift recipient.
The sales contract for the Product is deemed concluded and perfected when NMGC S.R.L. receives payment of the price from the Customer (which will occur according to the procedures described in Article 4 of the General Terms and Conditions).
Upon successful payment, the order is considered finalized. At that point, NMGC S.R.L. will send the Customer an order confirmation e-mail, containing a summary of the order placed, with detailed information about the Product(s) purchased and their characteristics, the total purchase price (excluding any customs duties), the delivery methods, and the delivery times. The Customer certifies that they have acknowledged the payment terms.
The order, which is displayed by the Customer and sent via e-mail, contains all the essential elements of the contract, including all legally required information. The Customer is required to check the order and verify that the information contained is correct and complete.
4. PRICES AND PAYMENTS
On the Site, next to the image of the Product, the price is indicated, as well as its main characteristics, available sizes, and the indication of the possibility to have the Product made to measure.
Prices are expressed in Euros and include VAT.
Shipping costs are governed by Article 5 below.
Customs duties are not included in the price and are always borne by the Customer, even if the Product is delivered to a person other than the Customer, such as a gift recipient. The amount of such customs duties is at the discretion of the customs agency within the destination country and is partly determined by the value of the item. Therefore, it is the Customer’s responsibility to check with their country’s customs office before purchase what additional costs will be applied to the order. In no case will NMGC S.R.L. be liable for the Customer’s failure to check this or be responsible for paying customs duties.
Product prices may be changed at any time by the Seller, without notice. Consequently, adding a Product to the “shopping cart” does not guarantee that, if the purchase operation is not completed, the price will remain the same as when it was added to the cart.
The information, and in particular the prices displayed on the Site, may contain errors due to system failures. The Seller remains committed to preventing such errors, although they may still occur. Orders placed with incorrect price information will be automatically canceled by the Seller. If the displayed price is lower than the actual price of the Product, the Seller will contact the Customer via e-mail to cancel the order or provide instructions on how to pay the price difference.
Payment for the Products must be made by credit card or by using the Paypal digital payment service.
If the Customer fails to pay the price, the contract is considered not concluded.
5. SHIPPING AND DELIVERY
Products will be shipped by NMGC S.R.L. to the shipping address indicated by the Customer in the purchase order.
Delivery is made through reliable couriers. Shipping costs are specified on the Site at the time of the order and are borne by the Customer, unless otherwise indicated on the Site.
Shipping times are indicated on the Site and in the order confirmation. NMGC S.R.L. will make every effort to respect the indicated delivery times. However, the Seller is not responsible for delays due to causes not attributable to it, such as force majeure, strikes, or delays by the carrier.
Upon delivery, the Customer must check that:
• the packaging is intact, undamaged, and not tampered with;
• the quantity and nature of the Products delivered correspond to what is indicated in the transport document.
Any discrepancies must be reported immediately to the carrier and subsequently communicated to NMGC S.R.L. via e-mail within 24 hours of delivery. In the absence of such a communication, the Products will be considered accepted in the state in which they were delivered.
6. RIGHT OF WITHDRAWAL
If the Customer qualifies as a consumer, as defined by Article 3 of the Consumer Code, they have the right to withdraw from the contract within 14 (fourteen) days of receiving the Product without any penalty and without specifying the reason.
To exercise this right, the Customer must send a written communication via e-mail to shop@nadetteboutique.com within the 14-day period, clearly stating their intention to withdraw from the purchase.
The Products must be returned, at the Customer’s expense, to the Seller’s address: NMGC S.R.L. Via San Michele 15, Busto Arsizio (Va) – Italy, in perfect condition, unused, complete with all their parts and accessories, and in their original packaging.
The refund will be made within 14 days of receipt of the returned Products, using the same payment method used by the Customer for the initial purchase, unless otherwise agreed between the parties.
The right of withdrawal is excluded for Products made to measure or customized at the Customer’s request.
7. EXERCISE OF THE RIGHT OF WITHDRAWAL VIA DIGITAL INTERFACE
- the dedicated digital function “Request Withdrawal” or “Withdraw from Contract”, accessible on the Website;
- the standard withdrawal form provided for by applicable legislation;
The online procedure requires the identification of the Consumer and the order subject to withdrawal and includes a subsequent confirmation step before final submission of the request.
After submission of the request via the digital interface, the Consumer will receive without undue delay a confirmation of receipt on a durable medium (e.g. email), containing the content of the request, the date, and the time of submission.
The exclusions from the right of withdrawal provided for under Article 59 of the Consumer Code remain unaffected.
The direct costs of returning the products shall be borne by the Consumer.
Information regarding the right of withdrawal, its exercise, applicable limitations, and the location of the online withdrawal function is made available to the Consumer before the conclusion of the contract through these Terms and Conditions and the additional informational sections of the Website dedicated to returns and refunds.
8. WARRANTIES
Products sold through the Site are covered by the legal warranty provided for in Articles 128 et seq. of the Consumer Code.
The warranty applies to Products that have conformity defects that occur within 2 (two) years from the date of delivery.
To benefit from the warranty, the Customer must notify NMGC S.R.L. of the defect within 2 (two) months of discovering it, by sending an e-mail to shop@nadetteboutique.com, specifying the defect found and providing photographic evidence, if possible.
In case of non-conformity, the Customer may request:
• the repair or replacement of the Product, free of charge;
• or, if these remedies are impossible or excessively burdensome, an appropriate price reduction or the termination of the contract.
9. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are governed by Italian law.
For disputes with Customers who are consumers, the competent court is the court of the Customer’s place of residence or domicile.
10. PRIVACY POLICY
For information regarding the processing of personal data, please refer to the “Privacy Policy” section available on the Site.
11. RETENTION OF THE CONTRACT
The contract and the related order documents are stored and archived by NMGC S.R.L. at its office located at Via San Michele 15, 21052 Busto Arsizio (Va).
The Customer may request access to and inspection of these documents, and possibly request a copy, by sending a written request to NMGC S.R.L. at least seven working days in advance, via e-mail to the following address: shop@nadetteboutique.com.
In any case, the Customer remains responsible for retaining and storing a copy of the contract, both in electronic and paper format.
12. APPLICABLE LAW
This contract is governed by Italian law.
For any matters not expressly covered by these general terms and conditions of sale, the applicable Italian laws shall apply.
